Terms and Conditions

These Website Terms and Conditions (“Terms”) govern your access to and use of mantalights.com (the “Website”), operated by Manta Lighting LLC (“Manta Lighting,” “Manta,” “we,” “us,” or “our”).

By accessing or using this Website, submitting a form, requesting a quote, or otherwise interacting with the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. Website Purpose

The Website provides information regarding Manta Lighting’s permanent outdoor lighting products, installation services, service areas, promotions, financing options, project examples, and related services.

Information provided on the Website is for general informational and marketing purposes. Website content does not, by itself, constitute a binding offer, installation agreement, warranty, guarantee, or contract for services.

2. Quote Requests and Estimates

Customers may use the Website to request information, schedule a consultation, or request a quote.

Submitting a quote or contact form does not obligate Manta Lighting to perform work and does not obligate the customer to purchase services.

Unless otherwise stated in writing, quotes issued by Manta Lighting are valid for thirty (30) days.

Quoted prices are based on the scope of work, property conditions, information available to Manta Lighting, and customer selections existing when the quote is prepared.

Pricing may be revised before or after a quote is issued when reasonably necessary because of circumstances including, but not limited to:

• Changes requested by the customer;

• Additions or reductions to the scope of work;

• Changes in product or layout selections;

• Required electrical work or installation of outlets;

• Previously unknown or concealed property conditions;

• Structural or accessibility conditions affecting installation;

• Additional labor or materials;

• Customer-requested discounts or modifications;

• Promotions or discounts offered by Manta Lighting; or

• Other mutually agreed changes.

Any final project will be governed by the applicable Jobber quote, Customer Installation Agreement, approved change orders, and any other written project-specific agreements.

If these Website Terms conflict with an executed Customer Installation Agreement, approved Jobber quote, financing agreement, or other project-specific written agreement, the project-specific agreement controls with respect to that project.

3. Project Deposits

Manta Lighting’s standard project structure generally requires a deposit equal to fifty percent (50%) of the project price before scheduling or ordering project materials.

The specific deposit required for a project will be stated in the applicable quote or agreement.

Manta Lighting may approve alternative payment arrangements or financing in its discretion. The availability of alternative arrangements does not alter Manta Lighting’s standard deposit requirement or require Manta Lighting to offer alternative terms to any particular customer.

Because permanent lighting systems are custom ordered and configured for individual properties, deposits become non-refundable once project materials have been ordered.

If a customer cancels before materials have been ordered, Manta Lighting may, in its sole discretion, refund some or all of the deposit after accounting for expenses and commitments already incurred.

Any cancellation right required by applicable law will remain unaffected by this section.

4. Payment

Unless otherwise agreed in writing, any remaining project balance is due immediately upon completion of installation.

Manta Lighting may require final payment before installation when provided for in the applicable project documents.

Manta Lighting accepts commonly available payment methods, including credit cards, electronic payments, checks, cash, and approved financing.

Payments made by credit card are subject to a three percent (3%) processing fee where permitted by applicable law.

If any amount remains unpaid thirty (30) days after its due date, Manta Lighting may assess a late fee equal to two percent (2%) of the unpaid principal balance. An additional late fee equal to two percent (2%) of the unpaid principal balance may be assessed for each additional thirty (30) day period the balance remains unpaid. Late fees shall be calculated only on the unpaid principal balance, shall not compound upon previously assessed late fees, and shall not exceed an aggregate of nine percent (9%) of the same delinquent principal balance during any twelve (12) month period. If the next scheduled late fee would cause the aggregate late fees to exceed this limit, only the amount necessary to reach the nine percent (9%) limit may be assessed. In all cases, late fees shall not exceed the maximum amount permitted by applicable law.

Manta Lighting reserves all lawful remedies for unpaid amounts, including collection efforts, recovery of applicable costs and attorney’s fees, and lien rights when available.

5. Financing

Manta Lighting may make third-party financing available, including financing through Wisetack or other providers.

Financing is offered by third parties and is subject to the financing provider’s own eligibility requirements, credit approval, rates, terms, disclosures, privacy practices, and agreements.

Manta Lighting does not guarantee financing approval, rates, payment amounts, financing availability, or the continued availability of any particular financing provider.

A financing provider’s services are separate from Manta Lighting’s installation services.

6. Installation Scheduling

Manta Lighting commonly schedules installations approximately one (1) to three (3) weeks after execution of project documents and satisfaction of applicable deposit or financing requirements. This timeframe is an estimate only and is not guaranteed.

Installation dates and completion dates may be changed as reasonably necessary.

Delays may occur because of weather, unsafe working conditions, material availability, supplier delays, shipping, staffing, customer-requested changes, site conditions, electrical work, other contractors, governmental actions, equipment issues, emergencies, or circumstances outside Manta Lighting’s reasonable control.

Manta Lighting is not liable for damages caused solely by a reasonable scheduling delay or circumstances outside its reasonable control.

7. Installation Methods

Permanent lighting installation may require fastening materials to the property using screws, fasteners, anchors, clips, track, conduit, wire, adhesives, drilling, and other normal installation methods.

Installation frequently involves drilling into or fastening to soffit, fascia, trim, siding, masonry, or other exterior building materials.

In limited situations, an appropriate installation may require penetration of a roof or roofing-related surface. When Manta Lighting makes such a penetration, it will use commercially reasonable methods to seal the penetration.

By approving a project, the customer acknowledges that these methods may be reasonably necessary to install the system.

Manta Lighting is not responsible for ordinary cosmetic effects inherent in an approved installation method or for damage resulting from concealed defects, pre-existing conditions, deterioration, fragile building materials, improper prior construction, or other conditions that could not reasonably have been identified before installation, except to the extent liability cannot legally be excluded.

8. Pre-Existing and Unexpected Property Conditions

Customers are responsible for notifying Manta Lighting of known conditions that may affect installation, including concealed electrical systems, wiring, plumbing, irrigation, utilities, structural problems, roof problems, damaged soffit or fascia, pest damage, water damage, prior repairs, unusual construction, or other relevant conditions.

Manta Lighting is not responsible for pre-existing damage or defects.

If Manta Lighting discovers a condition that prevents, delays, complicates, or materially increases the cost of the planned installation, Manta Lighting may pause or modify the work until the condition is addressed.

The customer is responsible for reasonable additional costs resulting from such conditions, including:

• Hiring an appropriate third-party contractor;

• Additional materials;

• Additional technician labor;

• Electrical work;

• Repairs necessary before installation can continue; or

• Changes to the installation plan.

If Manta Lighting agrees to perform work outside the normal scope of permanent lighting installation to address such a condition, that work may be billed at Manta Lighting’s then-current service or labor rate.

Unless separately agreed in writing, work performed by Manta Lighting outside the permanent lighting system is provided only to facilitate the lighting installation and does not create an ongoing maintenance obligation or warranty for the unrelated property component.

9. Customer Responsibilities

Unless Manta Lighting specifically agrees otherwise in writing, the customer is responsible for:

• Providing safe and reasonable access to the property;

• Providing suitable electrical service and outlets required for the system;

• Maintaining working electrical service;

• Maintaining an adequate internet connection, Wi-Fi network, router, and compatible mobile device;

• Providing accurate information regarding the property;

• Disclosing known hidden conditions or hazards;

• Obtaining required HOA, condominium association, or similar private approvals;

• Removing or securing vehicles, furniture, decorations, stored items, animals, and other obstructions when reasonably necessary;

• Preventing unrestrained animals from interfering with installation personnel;

• Providing access to locked or restricted portions of the property when necessary; and

• Cooperating with reasonable installation and system-training requirements.

Manta Lighting may agree to install an outlet, perform electrical-related work through an appropriate provider, relocate an installation component, or address another customer responsibility. Any such work may constitute additional scope and may result in an additional charge.

10. Wi-Fi, Router, and Connectivity Issues

The lighting system may depend on the customer’s router, Wi-Fi network, mobile device, Bluetooth connection, internet connection, or third-party software.

The customer is responsible for maintaining compatible networking equipment and connectivity.

Manta Lighting does not warrant the performance, range, reliability, security, or continued compatibility of the customer’s internet connection, router, Wi-Fi network, mobile device, or other third-party equipment.

If Manta Lighting performs a service visit and determines that the problem is caused by the customer’s router, network, internet connection, mobile device, third-party hardware, or another condition outside the lighting system, the visit may be billed at Manta Lighting’s then-current service rate.

11. Lighting Application and Third-Party Technology

Customers generally operate their lighting system through the Bosso-branded lighting application or other software designated for the installed system.

Customers may be required to establish their own account with the applicable application or technology provider.

Certain software, firmware, servers, cloud services, wireless technologies, or application functionality may be owned, hosted, developed, licensed, or maintained by third parties.

Manta Lighting does not control and cannot guarantee uninterrupted availability, future updates, continued compatibility, server availability, feature availability, or long-term operation of third-party software or services.

Manta Lighting may provide reasonable support related to the lighting system itself but is not responsible for outages, discontinued features, software changes, account problems, networking problems, or service interruptions caused by a third party.

12. Customer Training

Manta Lighting will provide standard system-use training at no additional charge when the customer or another authorized person is available at the appropriate point during project completion.

Customers are responsible for coordinating availability for training.

If no authorized person is available for standard on-site training, subsequent training may be subject to the terms and fees contained in the Customer Installation Agreement.

13. Work in Progress

An installation that has not been completed should not be treated as a finished or fully operational lighting system.

Customers should not operate, modify, disconnect, reconfigure, or otherwise interfere with an unfinished installation unless instructed by Manta Lighting.

Use or modification of unfinished work is at the customer’s risk and may affect applicable warranty coverage.

14. Warranty

Workmanship Warranty

Manta Lighting warrants its installation workmanship and labor for one (1) year from the installation date.

After the one-year workmanship warranty expires, service and repair labor is billable at Manta Lighting’s then-current service rates unless otherwise required by law or agreed in writing.

Manufacturer Warranty

The lighting system is covered by a five (5) year manufacturer’s warranty on all components, including lights, wire, track, and control units. This warranty is provided directly by the manufacturer and covers defects in materials under normal use. Manta Lighting LLC is not the warrantor but will assist the Customer in submitting any warranty claims to the manufacturer if needed and will coordinate and fulfill applicable repairs.

After expiration of Manta Lighting’s one-year workmanship warranty, labor associated with diagnosis, removal, installation, or replacement of a manufacturer-warranted component may be billable at Manta Lighting LLC’s then-current service rates.

Transfer

This warranty is transferable one (1) time to the next property owner, provided Manta Lighting LLC is notified in writing within sixty (60) days of the property transfer.

Warranty Exclusions

Warranty coverage does not include damage or failure resulting from:

• Misuse or neglect;

• Accidents;

• Vandalism;

• Rodents, insects, pests, or animals;

• Lightning;

• Flooding;

• Hail;

• Fire;

• Extreme weather or other natural forces;

• Unauthorized alterations, repairs, modifications, or service;

•Work performed by someone other than Manta Lighting or an authorized representative;

• Failure of the customer’s internet, Wi-Fi, Bluetooth, router, network, or mobile device;

• Third-party applications or software;

• Use inconsistent with the system’s intended residential or commercial purpose; or

• Other exclusions contained in the applicable manufacturer warranty.

The applicable Customer Installation Agreement controls if its warranty terms differ from this Website summary.

15. Changes to the Work

Customers may request changes before or during installation.

Manta Lighting is not required to accept a requested change.

Approved changes may result in additional charges, additional materials, changes to the installation date, or additional installation time.

Project changes should be documented in writing, including through an updated quote, change order, invoice, text message, email, or other written confirmation acceptable to Manta Lighting.

Where a signed Customer Installation Agreement requires a particular method of approving a change order, that agreement controls.

16. Photographs and Marketing

Manta Lighting may photograph or video completed or in-progress installations for quality control, documentation, training, portfolio, advertising, social media, website, print, and other legitimate business or promotional uses.

Where a customer has agreed to a photo or marketing release in a project-specific agreement, that agreement governs Manta Lighting’s use of project imagery.

Manta Lighting will not intentionally publish private personal information merely because project photographs are taken.

17. Communications About Your Request

When you voluntarily provide your phone number or email address through the Website, you authorize Manta Lighting and its representatives to contact you regarding the quote, appointment, project, service request, or other inquiry that you submitted.

Contact may occur by telephone call, text message, or email.

Manta Lighting may contact quote-request customers promptly after submission.

Message and data rates may apply to text messages depending on your carrier and plan.

Providing a telephone number is not a requirement to purchase goods or services where prohibited by applicable law.

18. Promotional Email

If you provide Manta Lighting with your email address, Manta Lighting may send you occasional emails regarding company news, lighting information, seasonal reminders, offers, and promotions, subject to applicable law.

Marketing emails will provide an available method to unsubscribe from future promotional emails.

Unsubscribing from marketing emails does not prevent Manta Lighting from sending transactional or service-related communications reasonably necessary for an active quote, scheduled installation, invoice, warranty matter, customer-service request, or existing business relationship.

19. Promotional Text Messages

Manta Lighting will obtain any consent required by applicable law before sending promotional or marketing text messages where such consent is legally required.

Consent to receive marketing text messages is not a condition of purchasing Manta Lighting products or services.

Recipients may withdraw applicable text-marketing consent through the method provided in the message or by contacting Manta Lighting.

20. Website Tracking and Analytics

Manta Lighting may use cookies, pixels, analytics tools, advertising technologies, and similar technologies to understand Website traffic, measure advertising effectiveness, improve the Website, and support marketing.

These technologies may include tools provided by third parties such as Meta, Google, website hosting providers, analytics providers, and advertising platforms.

Collection and use of personal information through the Website are also subject to Manta Lighting’s Privacy Policy.

21. Website Accuracy

Manta Lighting attempts to keep Website information reasonably accurate and current but does not warrant that every photograph, description, specification, price, promotion, service area, warranty summary, availability estimate, or other piece of Website content will always be complete or current.

Product appearance, component designs, applications, software, installation techniques, manufacturers, features, and specifications may change.

Website photographs are examples of prior work and do not guarantee that another property will have an identical appearance or installation.

Manta Lighting reserves the right to correct errors and update Website information at any time.

22. Promotions and Discounts

Discounts and promotional offers may be subject to eligibility requirements, expiration dates, service-area restrictions, minimum project sizes, product restrictions, scheduling restrictions, or other conditions.

Unless expressly stated otherwise, promotions cannot be combined.

Manta Lighting may modify, suspend, or discontinue a promotion prior to acceptance of a binding project agreement.

Once a discount has been incorporated into an executed project agreement, the project agreement controls.

23. Service Areas

Manta Lighting currently performs installation services within Illinois.

Advertising, Website content, search-engine results, or the ability to submit a quote request from another state does not guarantee that Manta Lighting will perform services at that location.

Manta Lighting may expand, reduce, or otherwise change its service territory at any time.

24. Website Intellectual Property

Unless otherwise stated, the Website and its original content, branding, graphics, photographs, videos, layouts, logos, text, and other materials are owned by or licensed to Manta Lighting and are protected by applicable intellectual-property laws.

You may view and use Website content for ordinary personal purposes related to evaluating Manta Lighting’s services.

You may not copy, reproduce, republish, sell, commercially exploit, impersonate, or use Manta Lighting branding or Website content in a misleading manner without authorization.

Third-party names, trademarks, software, and logos remain the property of their respective owners.

25. Prohibited Website Use

You may not use the Website to:

• Violate applicable law;

• Attempt unauthorized access to the Website or related systems;

• Introduce malicious code or interfere with Website operation;

• Harvest personal information;

• Submit deliberately false or fraudulent requests;

• Impersonate another person;

• Infringe intellectual-property rights; or

• Use the Website in a manner designed to damage Manta Lighting or another person.

Manta Lighting may restrict access to the Website when reasonably necessary to protect the Website, its users, or the business.

26. Third-Party Websites and Services

The Website may contain links, embedded services, financing tools, maps, social-media content, reviews, scheduling tools, payment services, or other features operated by third parties.

Manta Lighting does not control third-party services and is not responsible for their content, security, availability, privacy practices, policies, or performance.

Use of a third-party service may be governed by separate terms between the customer and the third party.

27. Limitation of Liability

To the fullest extent permitted by applicable law, Manta Lighting will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the Website.

Manta Lighting is not responsible for Website interruptions, third-party service failures, internet outages, malicious third-party conduct, inaccurate information supplied by Website visitors, or circumstances outside Manta Lighting’s reasonable control.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Liability related to an actual lighting installation or contracted project is governed primarily by the applicable Customer Installation Agreement, quote, warranty terms, and other project documents.

28. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Manta Lighting LLC and its owners, employees, contractors, representatives, and agents from third-party claims, losses, or expenses arising from your unlawful misuse of the Website, deliberate submission of false information, infringement of another person’s rights, or violation of these Terms.

This provision does not require a consumer to indemnify Manta Lighting for Manta Lighting’s own liability where such indemnification is prohibited by law.

29. No Waiver

Manta Lighting’s failure to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision in the future.

Any accommodation, refund, cancellation exception, scheduling accommodation, discount, credit, or other courtesy provided by Manta Lighting on a particular occasion does not establish a continuing policy or create a right to the same accommodation in another situation.

30. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.

31. Governing Law and Venue

These Website Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

To the extent a dispute arising specifically from use of this Website is not governed by a separate project-specific agreement, the parties agree that an appropriate state court located in Tazewell County, Illinois, or an appropriate federal court having jurisdiction over the matter, will have jurisdiction and venue, subject to applicable law.

Disputes relating to an installation project remain subject to the governing-law and venue provisions of the applicable executed Customer Installation Agreement.

32. Changes to These Terms

Manta Lighting may revise these Website Terms periodically.

The current version will be posted on this Website with an updated effective date.

Changes will apply prospectively from the effective date of the revised Terms and will not modify the terms of an existing signed installation agreement unless the parties separately agree in writing.

33. Age and Capacity

The Website is intended for individuals who are legally capable of entering agreements applicable to their use of the Website.

Individuals under eighteen (18) years of age should not enter into a project agreement with Manta Lighting without the involvement and legally sufficient authorization of a parent, guardian, property owner, or other person legally capable of entering the agreement.

34. Entire Website Agreement

These Terms, together with the Privacy Policy and any other Website policies expressly incorporated by reference, constitute the agreement governing use of the Website.

These Website Terms do not replace an executed Jobber quote, Customer Installation Agreement, financing agreement, change order, invoice, or other project-specific agreement.
